Effective 1 May 2026. These terms govern your use of aviologistics.com and AVIO's shipping services. Please read carefully.
These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and AVIO Logistics ("AVIO", "we", "us"). By creating an account, requesting a quote or tendering a shipment, you accept these Terms.
1. Services
AVIO is a freight forwarder and shipping broker. We arrange transportation, customs clearance and related services through licensed carrier partners (FedEx, DHL, UPS, USPS and others). AVIO is not itself a carrier.
2. Accounts
You must provide accurate information when registering or booking. You are responsible for safeguarding your login credentials and for all activity on your account. Notify us immediately of any unauthorised use.
3. Rates & pricing
- Rate quotes are estimates based on the information you provide. Final pricing may adjust based on actual weight, dimensions, surcharges (fuel, residential, remote area, oversize) and customs duties.
- All prices are in US dollars unless stated otherwise. Currency conversions use the rate at time of invoicing.
- Payment terms are stated on each invoice. Past-due invoices accrue interest at 1.5% per month or the maximum permitted by law.
4. Prohibited items
You may not ship items prohibited by carrier policies, applicable law or international convention, including but not limited to:
- Hazardous materials not properly declared and packaged.
- Currency, negotiable instruments, precious metals.
- Live animals (without prior written approval).
- Narcotics, weapons, ammunition.
- Counterfeit or pirated goods, items violating sanctions.
You indemnify AVIO and its carriers for all losses arising from shipping prohibited items.
5. Documentation & declarations
You are solely responsible for accuracy of all declared values, contents, HS codes and consignee details. Misdeclaration may result in penalties, seizure, or refusal of shipment, for which AVIO is not liable.
6. Liability & insurance
- AVIO's liability is limited to the lesser of (a) the actual cash value of the goods or (b) the limit imposed by the controlling international convention (Warsaw, Montreal, CMR) or the chosen carrier's tariff.
- Cargo insurance up to $50,000 is included on air-freight bookings. Top-up insurance is available at quote time.
- AVIO is not liable for indirect, incidental, consequential or punitive damages, lost profits or loss of business.
7. Claims
Claims for loss or damage must be filed within 14 days of delivery (or expected delivery for lost shipments) at claims@aviologistics.com. Photographic evidence, packaging and invoice copies are required.
8. Force majeure
Neither party is liable for delays or non-performance due to events beyond reasonable control: natural disasters, war, strikes, pandemics, government action, carrier failure.
9. Termination
Either party may terminate with 30 days notice. AVIO may suspend service immediately for non-payment, fraud or material breach. Termination does not relieve you of accrued obligations.
10. Confidentiality
Rate cards, audit reports and contract terms are confidential. Do not disclose without written consent.
11. Governing law & disputes
These Terms are governed by the laws of the State of New Jersey, USA. Disputes will first be addressed through good-faith negotiation, then binding arbitration in Newark, NJ under the AAA Commercial Rules. Class actions are waived.
12. Modifications
We may update these Terms. Material changes take effect 30 days after notice via email or a prominent site banner. Continued use means acceptance.
